RangeTrace Customer Agreement (End User License Agreement).

1. Who this Agreement is between

RangeTrace (the “App”) is licensed to you, not sold, by SKJ Apps (“SKJ Apps”, “we”, “us”, or “our”). SKJ Apps retains all right, title, and interest in the App and all rights not expressly granted to you in this Agreement.

Where you obtain RangeTrace through a distribution marketplace such as the Setapp Marketplace or the Mac App Store, that marketplace and its operator are your point of purchase and provide the download to you. Section 4 explains the role of Setapp in more detail.

Where you buy RangeTrace directly from rangetrace.app, our online reseller Paddle.com is your point of purchase, and you download the App from rangetrace.app. Section 4 explains the role of Paddle.

2. License grant

Subject to your compliance with this Agreement, SKJ Apps grants you a personal, non-exclusive, non-transferable, revocable license to install and use RangeTrace on Mac computers that you own or control, for your own personal or internal business use. Your license is for the number of installations permitted by the marketplace or plan through which you obtained the App.

A license bought directly from rangetrace.app comes as a license key that unlocks the App on up to three Macs at a time. The App confirms the key with the SKJ Apps license server each time it opens, so it needs an internet connection to unlock. Deactivating the App on one Mac frees that Mac’s place for another.

3. What you may not do

You agree that you will not, and will not permit anyone else to:

• copy (except as needed for normal installation and backup), sell, rent, lease, sublicense, distribute, or otherwise transfer the App or your license to any third party;
• reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the limited extent this restriction is prohibited by applicable law;
• modify, adapt, translate, or create derivative works based on the App;
• remove, alter, or obscure any proprietary notices in the App;
• use the App to break any law, to infringe anyone’s rights, or in a way that harms or attempts to gain unauthorized access to any device, network, or data.

RangeTrace works with Dexcom Share, a service operated by Dexcom, Inc. that is not provided by SKJ Apps. Your use of your Dexcom account and Dexcom Share is governed by Dexcom’s own terms. SKJ Apps is not affiliated with, endorsed by, or sponsored by Dexcom, Inc.

4. Purchases through Setapp and Paddle (merchant of record)

If you obtain RangeTrace through the Setapp Marketplace operated by MacPaw (“Setapp”), you acknowledge and agree that:

• Setapp acts as the merchant of record for that transaction and is authorized by SKJ Apps to deliver and distribute the App to you and to grant (sublicense) to you the license described in this Agreement on SKJ Apps’ behalf;
• Setapp is authorized to sublicense RangeTrace to you in accordance with the applicable Setapp Developer Agreement (including sections 5.d, 5.f, and 5.g of that agreement), and this Agreement governs your use of the App once it has been delivered and sublicensed to you through Setapp;
• Setapp (and its payment provider) handle your purchase, billing, and account information as an independent controller under Setapp’s own terms and privacy policy, and questions about billing, your Setapp plan, or refunds for a Setapp purchase should be directed to Setapp.

If you buy RangeTrace directly from rangetrace.app, you acknowledge and agree that:

• our order process is conducted by our online reseller Paddle.com (“Paddle”), which is the merchant of record for all direct orders and handles payment, billing, invoicing, applicable sales tax or value-added tax, refunds, and chargebacks under its own buyer terms;
• SKJ Apps sends your license key by email, and the license described in section 2 covers up to three Macs at a time;
• we offer a 14-day, no-questions-asked refund on a direct purchase when you ask within fourteen (14) calendar days of the purchase, as the refund policy explains, and approved refunds are issued through Paddle;
• we may turn off a license key associated with a refund, a chargeback, a fraudulent purchase, unauthorized sharing of the key, or a material breach of this Agreement.

The same principle applies to any other marketplace you use: if you obtain RangeTrace through the Mac App Store, Apple handles your purchase, billing, and refunds under Apple’s terms, while your use of the App itself is governed by this Agreement.

5. Ownership and intellectual property

RangeTrace, including its software, design, text, graphics, icons, and the “RangeTrace” name and logo, is owned by SKJ Apps and is protected by copyright and other intellectual property laws. This Agreement gives you a license to use the App; it does not transfer any ownership to you. All rights not expressly granted are reserved by SKJ Apps.

6. Updates

SKJ Apps may release updates, bug fixes, and new versions of RangeTrace from time to time. Updates are delivered through the marketplace you obtained the App from (for example the Setapp Marketplace or the Mac App Store). Updates may add, change, or remove features. This Agreement applies to any update unless the update comes with its own separate terms.

A copy bought directly from rangetrace.app checks rangetrace.app for updates and installs an update only when it carries the SKJ Apps signature. You can turn automatic update checks off in the App’s settings.

7. Health information and no medical advice

RangeTrace is an informational companion that displays glucose data from your Dexcom Share account. It is not a medical device and does not provide medical advice. Do not use RangeTrace to make treatment decisions. Always confirm readings in your primary Dexcom app or with a blood glucose meter before acting. You are responsible for your own health decisions, and SKJ Apps is not liable for any decision made in reliance on information shown by the App.

8. Privacy

RangeTrace is built so your glucose data stays between your Mac and Dexcom. How the App handles data is described in the RangeTrace Privacy Policy at https://rangetrace.app/setapp-privacy, which is part of this Agreement by reference. Please read it.

For a copy bought directly from rangetrace.app, the RangeTrace Privacy Policy at https://rangetrace.app/privacy also describes what the purchase, the license key, and the license and update checks share, and is part of this Agreement by reference.

9. Disclaimer of warranties

To the maximum extent permitted by law, RangeTrace is provided “as is” and “as available”, without warranty of any kind, whether express, implied, or statutory. SKJ Apps disclaims all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. SKJ Apps does not warrant that the App will be uninterrupted, error free, or fully compatible with every macOS version or Dexcom account, or that every reading, alert, or notification will always be delivered.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. Nothing in this Agreement affects any statutory rights you have as a consumer that cannot be waived.

10. Limitation of liability

To the maximum extent permitted by law, SKJ Apps will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of or inability to use RangeTrace, even if SKJ Apps has been advised of the possibility of such damages.

To the maximum extent permitted by law, the total liability of SKJ Apps for all claims relating to RangeTrace will not exceed the amount you actually paid for the App in the twelve months before the event giving rise to the claim, or, if you obtained the App as part of a marketplace plan or bundle, a reasonable amount attributable to the App.

11. Termination

This Agreement and your license last until terminated. Your license ends automatically if you break any of its terms. You may end it at any time by deleting RangeTrace and stopping all use of it. On termination you must stop using the App and remove it from your Mac. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and governing law) will survive.

12. Changes to this Agreement

SKJ Apps may update this Agreement to reflect changes to the App or to legal requirements. When we make a material change, we will post the updated Agreement at https://rangetrace.app before it takes effect. Your continued use of RangeTrace after an update means you accept the updated Agreement.

13. Governing law

This Agreement is governed by the laws applicable at SKJ Apps’ place of business, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your country of residence provide otherwise.
